AGREEMENT BETWEEN 1-STOPNOTARY.COM AND ITS SUBSCRIBERS/YOU

1-StopNotary.com is a Web service operated by 1-Stop Notary, LLC (“1-StopNotary.com”) that makes it easy for

(1) mobile notaries public to advertise their services, collaborate with their peers, and manage their business,
 
(2) for consumers to locate mobile notaries public to serve as their agents and to track related services, and

(3) for notaries public to purchase notary-related supplies.  You can find out more about 1-StopNotary.com by going to our web site.

These Terms of Use constitute a legal agreement between you and 1-StopNotary. You must accept without modification all of the terms, conditions, and notices contained in these Terms of Use in order to access and use the 1-StopNotary. If you do not accept these Terms of Use in their entirety, you may not access or use the 1-StopNotary.

Portions of the 1-StopNotary may be governed by posted guidelines, rules, or other terms and conditions. All such guidelines, rules, and terms and conditions are hereby incorporated by reference into these Terms of Use. In the event of a conflict between such other guidelines, rules, and terms and conditions and these Terms of Use, the Terms of Use shall control. However, the 1-StopNotary Privacy Statement, discussed in the Privacy and Personal Information section below, supersedes any conflicting language in these Terms of Use and/or any other guidelines, rules, and terms and conditions published on the 1-StopNotary Web Site with respect to the subject matter covered by the 1-StopNotary Privacy Statement.

MODIFICATION OF THESE TERMS OF USE

1-StopNotary may wish to update or change the terms, conditions, and notices for 1-StopNotary from time to time to reflect changes in the Services, changes in the laws affecting the Services, or for other good reasons. You understand that 1-StopNotary reserves the right to make these changes and that you are responsible for regularly reviewing these terms, conditions, and notices. Continued access to or the use of 1-StopNotary.com after any such change shall constitute your consent to such change. Unless explicitly stated otherwise, any new features that change or improve 1-StopNotary.com shall be subject to the Terms of Use, as modified from time to time.

PERSONAL AND NON-COMMERCIAL USE LIMITATION

You may only use the 1-StopNotary.com for your own personal and non-commercial purposes. You must enter into a different legal agreement with 1-StopNotary if you wish to offer 1-StopNotary.com to users of your own application, Web site, or Web service. You may not use any software or hardware that reduces the number of users directly accessing or using 1-StopNotary.com (sometimes called "multiplexing" or "pooling" software or hardware).

You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services that are part of 1-StopNotary.com or its products contained therein except as expressly provided in these Terms of Use or by special permission from 1-StopNotary.

PRIVACY AND PERSONAL INFORMATION

You are required to subscribe to 1-StopNotary and set up an account to use the 1-StopNotary.com and its services. To set up an account, you must provide information about yourself and update this information as necessary in order to keep it current. 1-StopNotary agrees that it will only use your personal information in accordance with the terms of 1-StopNotary’s Privacy Statement.

You are responsible for maintaining the confidentiality of your password and account information. Furthermore, you are responsible for all activities that occur in your account and you agree to notify 1-StopNotary immediately of any unauthorized use of your account. 1-StopNotary is not responsible for any loss that you may incur as a result of any unauthorized person using your account or your password.

LINKS TO THIRD-PARTY SITES

The Web pages that are part of the 1-StopNotary Web Site may contain links to other Web sites ("Linked Sites"). The Linked Sites are not under the control of 1-StopNotary and 1-StopNotary is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. 1-StopNotary is not responsible for webcasting or any other form of transmission received from any Linked Site, nor is 1-StopNotary responsible if the Linked Site is not working appropriately. 1-StopNotary is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by 1-StopNotary of the site or any association with its operators. You are responsible for viewing and abiding by the privacy statements and terms of use posted at the Linked Sites.

You are solely responsible for any dealings with third parties (including advertisers) who support 1-StopNotary or are identified in the Web pages that are part of 1-StopNotary.com, including the delivery of and payment for goods and services.

NO UNLAWFUL OR PROHIBITED USE

As a condition of your use of the 1-StopNotary, you agree that you will not use 1-StopNotary.com for any purpose that is unlawful or contrary to these Terms of Use.

You also may not use 1-StopNotary.com in any manner that could damage, disable, overburden, or impair the 1-StopNotary.com or interfere with any other party's use and enjoyment of them. You may not attempt to gain unauthorized access to any 1-StopNotary account, computer systems or networks associated with 1-StopNotary.com. This section also is not applicable to any documents, information, or other data that you upload, transmit or otherwise submit to or through any 1-StopNotary participating sites and services. Please refer to the terms and conditions for such 1-StopNotary participating sites and services to determine the rights of the Web site or service provider to such documents, information and/or data.

TERMINATION AND RESTRICTION OF ACCESS

1-StopNotary.com reserves the right, in its sole discretion, to terminate your access to its Web pages or any portion thereof at any time, without notice.

1-StopNotary.com may also terminate or suspend your access to the notary section of 1-StopNotary.com for inactivity, which is defined as failing to make the required renewal payments, credit card declines, etc. Upon termination of your 1-StopNotary.com account, your right to use the Web pages immediately ceases.

GENERAL

These Terms of Use are governed by the laws of the State of Michigan, U.S.A. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Manistee, Michigan, U.S.A. in all disputes arising out of or relating to the use of 1-StopNotary.com Services or 1-StopNotary.com Products. You agree that no joint venture, partnership, employment, or agency relationship exists between you and 1-StopNotary.com as a result of these Terms of Use or use of 1-StopNotary.com Services.

1-StopNotary.com may assign these Terms of Use, in whole or in part, at any time. 1-StopNotary.com's performance of this agreement is subject to existing laws and legal process, and nothing contained in these Terms of Use is in derogation of 1-StopNotary.com's right to comply with governmental, court, and law enforcement requests or requirements relating to your use of 1-StopNotary.com’s Services or information provided to or gathered by 1-StopNotary.com with respect to such use. You agree to indemnify and hold 1-StopNotary.com, its parents, subsidiaries, affiliates, officers, and employees, harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of your use of or conduct on 1-StopNotary.com’s Services.

If any part of these Terms of Use are determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms of Use shall continue in effect. These Terms of Use, including the documents expressly incorporated by reference above, constitute the entire agreement between you and 1-StopNotary.com with respect to 1-StopNotary.com’s Services and such agreements supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and 1-StopNotary.com with respect to 1-StopNotary.com’s Services. A printed version of these Terms of Use and of any notices given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

OUT OF STOCK POLICY

The most important thing to keep in mind when ordering is that our stock balances fluctuate throughout the day with sales demand and stock that we receive from the manufacturers. Items are constantly being sold and our stock is constantly being replenished. If the item is identified as "Out of Stock", we can special order the item for you and ship it as soon as we get it. Most items ship within 2 weeks.
 
Just because the item you ordered is NOT identified as out-of-stock does not necessarily mean that it will be in-stock at the moment you order it. We will notify you if the item you ordered is out-of-stock. We first try to reply via email and give you 3 days to reply. If we have not heard from you we will then try to call you at the numbers you provide with your order. Be sure to give us your current email address and phone number.

Some items are listed for sale on our web site that have not been released from the manufacturer yet. We place these items on the web site so that consumers may pre-order the items. Preorders are reserved with payment up front on a first come, first served basis. You may also request to be placed on a “notify list” and we will let you know when products are in-stock and available for delivery. Be advised that prepaid orders always get priority for delivery.
 
Many out-of-stock items are excellent products and are available for purchase, but we do not always stock these items in inventory. We will be happy to special order these items for you in a timely fashion. Again, most items ship within 2 weeks.

ORDER CANCELLATION POLICY (SUPPLIES)

Please submit any cancellation via email to sales@1-StopNotary.com.

Email cancellations must contain the following: First name, last name, order number, and email address. This information must be identical to the information originally submitted on your order. Please provide contact information so that we may contact you if we have questions in regards to canceling your order.

Every effort will be made to accommodate the cancellation of your order, providing your order has not been charged and/or shipped out. In the event that a cancellation was submitted (via email or phone), and your order was shipped out after, we will gladly refund the complete balance charged including shipping. However, if the cancellation was documented as received after the order was shipped, we will refund the merchandise total less shipping.

REOCCURRING SUBSCRIPTION CHARGES

All 1-Month, 3-Month, 6-Month and 1-Year membership subscriptions are reoccurring unless membership is cancelled prior to the end of the current billing cycle.  Please refer to cancellation of subscription policy for additional details.

CANCELLATION OF SUBSCRIPTION

Please submit any cancellation via email to sales@1-StopNotary.com.

No refunds will be given for any unused portions of membership subscriptions.  All memberships are non-refundable at the time of sign up.  ALL MEMBERSHIP SALES ARE FINAL.  All billing/charges for subscriptions are reoccurring and therefore, will be recharged to the account/credit card given at the end of the current subscription cycle, unless canceled by the subscriber by the required cancellation deadline.  All cancellations must be received within ten (10) days prior to the next billing cycle.  If no notice is given and the account/credit card is charged for the renewal period, member acknowledges that no refund will be given and the cancellation will take effect at the end of that renewal period.  NO REFUNDS WILL BE GIVEN unless proper notice was received.
